1. Agreement to Terms

By accessing or using RunwayModeler ("Service"), operated by Portrait Labs ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

RunwayModeler is a Bayesian burn rate simulation tool that helps startup founders model their cash runway using probabilistic forecasting. The Service provides:

  • Natural language scenario input and extraction
  • Monte Carlo simulation-based runway analysis
  • Risk quantification and sensitivity analysis
  • Actionable recommendations based on simulation results

3. User Accounts

3.1 Account Creation

To use RunwayModeler, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities

You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or harmful activity.

4. Subscription and Billing

4.1 Free Trial

New users receive a 14-day free trial with full access to all features. No credit card is required for the trial.

4.2 Subscription Plans

After the trial, continued access requires a paid subscription at $79 per month. Subscriptions are billed monthly and renew automatically.

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you retain access until the end of your current billing period.

4.4 Refunds

We offer a 30-day money-back guarantee for new subscribers. Refund requests after 30 days are handled on a case-by-case basis.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Reverse engineer or decompile any part of the Service
  • Use automated systems to access the Service without permission
  • Share your account credentials with third parties
  • Use the Service to compete with RunwayModeler

6. Intellectual Property

6.1 Our Property

The Service, including its design, features, algorithms, and content, is owned by Portrait Labs and protected by intellectual property laws. You receive a limited, non-exclusive license to use the Service as intended.

6.2 Your Data

You retain ownership of all data you input into the Service. By using the Service, you grant us a limited license to process your data as necessary to provide the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • Results obtained from the Service will be accurate or reliable
  • The Service will meet your specific requirements

Important: RunwayModeler provides probabilistic forecasts for informational purposes only. Our simulations are based on the data you provide and statistical models that involve inherent uncertainty. Results should not be considered financial advice. You should consult with qualified financial advisors before making business decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTRAIT LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Business interruption or data loss
  • Decisions made based on Service outputs

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Portrait Labs and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Arkansas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Pulaski County, Arkansas.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Portrait Labs regarding the Service.
